Welcome to Loprice's Terms of Service!

The first portion of our Terms of Service is an introduction, which is structured like an FAQ and lays out some high-level concepts before diving into other terms.

What documents make up the TOS?

We refer to the Terms of Service as the "TOS"

This page lays out the core of our TOS, but we also have other contractual documents that you can think of as additional terms for specific topics. Legally speaking, these other documents are incorporated by reference as if they were written here and form part of the overall TOS. Therefore, you should also review these other documents, which can be found at the links below:

Privacy Policy, which outlines how we collect, use, and share data in our Websites and Services.
Service fee, which explain a subscription fee in relation to the services our platform provides to you.

Whom does this TOS apply to?

When we refer to "Loprice" or we use pronouns like "we", "us" or "our", we are referring to Loprice app, LOPRICE LIMITED, affiliates and partner companies
When we refer to the "User", we are talking about you, and we will also use words like "you" and "your" to refer to you. Who "you" are can get more complicated if you are using our services on behalf of a company, organization, or other entity. In that case, you are representing to us that you have the authority to bind your company, organization, other entity to this TOS and that you agree to be legally bound by this TOS on behalf of such entity (and "User", "you", and "your" then refer to such entity). If you aren't sure what this means or whether you are authorized to bind your company, organization, or entity to this contract, you should ask others in your organization to get clarification about authority.

What is the TOS?

This TOS is a binding contract between you and Loprice, and covers all of the offerings, websites, products, services, features, content, applications and other things we offer to users like you.

We will periodically differentiate between our websites such as loprice.co.tz(which we will refer to collectively as the "Websites") , company.loprice.co.tz, app.loprice.co.tz, manager.loprice.co.tz, manager2.loprice.co.tz(which we will refer to collectively as the "Webapps") and all of our other services, such as our application, webapps and other paid services (which we will refer to collectively as the "Services").

Now that we have some common language, we want to ensure you understand when and how the TOS applies.

First and foremost, you must understand that this is a binding legal contract that is required to use our Websites and Services. As such, you may only use our Websites and Services if you agree that you have read, understood, and consented to be bound by this TOS.

If you access or use our Websites and Services, this TOS applies and is legally binding on you and to your access and use. These are common examples, and this paragraph does not necessarily include all the other ways you can become bound to this TOS.

What happens with disputes under this TOS?

When there is any disputes under this TOS we will try to resolve between you and us in a fairly resolution upon consent to both parties and only if the matter does not fall under criminal offenses. And if the matter is of criminal nature or non criminal nature but failed the resolution between both parties, the matter will be resolved by using the laws of THE UNITED REPUBLIC OF TANZANIA.


Terms & Conditions of the TOS

1. Eligibility & Registration

1.1 Before you use our Websites and Services, you must ensure that such use is in compliance with all laws, rules and regulations applicable to you. Your right to access the Websites and Services is revoked to the extent your use thereof is prohibited or to the extent our provision thereof conflicts with any applicable law, rule or regulation. You are responsible for making these determinations before using the Websites and Services.

1.2 The Websites and Services are not targeted towards, nor intended for use by, anyone under the age of 18. By using the Websites and Services, you represent and warrant to us that: (a) you are 18 years of age or older; or (b) you otherwise have sufficient legal consent, permission and capacity to use the Websites and Services in applicable jurisdiction(s) as determined by you.

1.3 To access the Services and some features of the app, you must register for an account ("Account"). When you register for your Account, you may be required to provide us with some information about yourself, such as your name, email address, and a valid form of payment, and you may also provide optional information about yourself on a voluntary basis. Account information, and our use and disclosure thereof, is subject to the Privacy Policy.

1.4 We may, in our sole discretion, refuse to provide or continue providing the Website and Services to any person or entity and change eligibility criteria at any time, including if you fail to comply with the TOS. We reserve the right to deactivate, terminate, prevent access to, disable services for, and/or delete any Accounts or access to the Websites and Services at any time at our sole discretion.

2. Loprice's Proprietary Rights

2.1 As between you and Loprice, the Websites and Services are owned and/or provided by Loprice. The names, logos, trademarks, trade dress, arrangements, visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Websites and Services ("Materials") that we provide are protected by intellectual property and other laws. All Materials included in the Websites and Services are the property of Loprice or its third party licensors. You may only use the Websites and Services as expressly authorized by us and as set forth in this TOS. You shall abide by and maintain all intellectual property notices, information, and restrictions contained in the Websites and Services. We reserve all rights to the Websites and Services not granted expressly in this TOS.

2.2 If you choose to provide input and suggestions regarding problems with or proposed modifications or improvements to the Websites and Services ("Feedback") then you hereby grant to us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to exploit the Feedback in any manner and for any purpose, including to improve the Websites and Services and create other products and services.

2.3 You grant us permission to include your name, logos, and trademarks in our promotional and marketing materials and communications.

2.4 Some of the Materials provided by Loprice are licensed under one or more open source, Apache license, or similar licenses (collectively, "Open Source Licenses"). Nothing in this TOS prevents, restricts, or is intended to prevent or restrict you from obtaining such materials under the applicable Open Source Licenses or to limit your use of such materials under those Open Source Licenses.

2.5 Subject to your complete and ongoing compliance with this TOS and our rights therein, Loprice grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Websites and/or Services as described in and subject to this TOS.


3. DO Community & User Content

3.1 Certain features of the App(Loprice) permit you to submit or upload content, including messages, reviews, media, images, folders, data, text, and other types of works (your "User Content") and to publish your User Content on our App.

3.2 By providing your User Content to or via the Websites, you grant Loprice a worldwide, non-exclusive, royalty-free, fully paid right and license (with the right to sublicense) to host, store, transfer, display, perform, reproduce, modify for the purpose of formatting for display, and distribute your User Content, in whole or in part, in any media formats and through any media channels.

3.3 By providing your User Content via the App, you grant to our other users a non-exclusive license to access and use your User Content as permitted by this TOS and the functionality of the App.

3.4 You are solely responsible for your User Content, and you agree Loprice is not and will not be in any way liable for your User Content. By providing your User Content via the App, you affirm, represent, and warrant that:

you are the creator and owner of your User Content, or have the necessary licenses, rights, consents, and permissions to authorize Loprice and users of the App to use and distribute your User Content as necessary to exercise the licenses granted by you in this TOS or otherwise required of you under this TOS;
your User Content, and use of your User Content as contemplated by this TOS, does not and will not: (i) infringe, violate, or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) slander, defame, libel, or invade a right of privacy, publicity or other property right of any other person; or (iii) cause us to violate any law or regulation; and
you will indemnify us for any third party claims arising from your User Content.

3.5 We are under no obligation to edit or control your User Content or the User Content of others, and will not be in any way responsible or liable for User Content. We may, however, at any time and without prior notice, screen, remove, edit, or block any of your User Content at our discretion.

3.6 By submitting or uploading your User Content, you also agree to abide by the terms of any Open Source Licenses that may apply to your User Content.

4. Content and data storage

4.1 You consent to the storage of your Services Content in, and transfer of your Services Content into, the geographic region and jurisdiction we select. Unless otherwise agreed in writing between you and Loprice, you agree that Loprice may transfer and store your Services Content in other geographic regions or jurisdictions at its sole discretion. You represent and warrant that such storage and transfer are adequately consented to by you and permissible pursuant to applicable laws, regulations, rules, and third party rights.


5. Rules of Conduct

5.1 You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Websites or Services (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Websites or Services; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations. To the extent any portions of the Websites or Services are subject to Open Source Licenses, such Open Source Licenses apply regardless of this section.

5.2 We reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) respond to any applicable law, regulation, legal process or governmental request; (ii) enforce this TOS, including investigation of potential violations hereof; (iii) detect, prevent, or otherwise address fraud, security or technical issues; (iv) respond to user support requests; or (v) protect the rights, property or safety of us, our users and the public. More information is available in our Law Enforcement Guidelines.

5.3 You shall utilize proper security protocols, such as setting strong passwords and access control mechanisms, safeguarding access to all logins and passwords, and verifying the trustworthiness of persons who are entrusted with account access information. You are solely responsible for any unauthorized access to your Account, and must notify Loprice immediately of any such unauthorized access upon becoming aware of it.

5.4 You shall notify Loprice if and when you learn of any security incidents or breaches affecting the Websites or Services, including unauthorized access to your Account or Account credentials, and shall aid in any investigation or legal action that is taken by authorities and/or Loprice to investigate and cure the security incident or breach to the extent caused by your Account or your use of the Websites and Services. 

6. Payments and Billing

6.1 We use third-party payment processors (the "Payment Processors") to bill you through the payment account(s) linked to your Account during subscription (your "Billing Information"). The processing of payments may be subject to the terms, conditions and policies of the Payment Processors in addition to this TOS. We are not responsible for acts or omissions of the Payment Processors. You agree to pay us, through the Payment Processors or as otherwise agreed to by Loprice, all sums for Services you select or use at applicable prices in accordance with our pricing and billing policies (Loprice ) when logged into your Loprice account and you hereby authorize us and applicable Payment Processors to charge all such sums (including all applicable taxes and transaction fee of the "Payment Processors") to the payment method(s) specified in or linked to your Account (your "Payment Method").

6.2 You must provide current, complete and accurate information for your Account and Billing Information, and must promptly update all such information in the event of changes (such as a change in billing address, credit card number, or credit card expiration date). You must promptly notify us or our Payment Processors if your payment method is canceled (e.g., for loss or theft) or otherwise inoperable. Changes to such information can be made in your account settings.

6.3 By entering into this TOS and using the Services, you agree to be billed on a recurring basis and to be automatically charged by us or our Payment Processors using your Payment Methods upon invoicing. If your Payment Method or payment of fees is subject to other terms and conditions, as set forth in order forms, invoices or otherwise, then those other terms and conditions apply in addition to this TOS. You may also be billed an amount up to your current balance at any time to verify the accuracy of your account information. We reserve the right to deactivate, terminate, prevent access to, disable services for, and/or delete any Accounts or access to the Websites and Services at any time at our sole discretion, including for nonpayment, late payment, or failure to charge your Payment Methods upon invoicing.

6.4 You are responsible for any duties, customs fees, taxes, and related penalties, fines, audits, interest and back-payments relating to your purchase of the Services, including but not limited to national, state or local sales taxes, use taxes, value-added taxes (VAT) and goods and services taxes (GST) (collectively, "Taxes"). Unless otherwise stated, our pricing policies do not include and are not discounted or enhanced for any such Taxes. If we become obligated to collect or pay Taxes in connection with your purchase of the Services, those Taxes will be invoiced to you as part of a billing process or collected at the time of purchase. In certain states, countries and territories, we may determine if your purchase of Services is subject to certain Taxes, and if so, may collect such Taxes and remit them to the appropriate taxing authority. If you believe that a given Tax does not apply or that some amount must be withheld from payments to us, you must promptly provide us with a tax certificate, withholding receipt, tax identifier (e.g., VAT ID) or other adequate proof, provided such information is valid and sufficiently authorized by all appropriate taxing authorities. You must also provide us with any tax identification information that is necessary for us to comply with our tax obligations, as we determine from time to time. You will be solely responsible for any misrepresentations made or non-compliance caused by you regarding Taxes, whether with respect to us or other parties, including any penalties, fines, audits, interest, back-payments or further taxes associated with such misrepresentations or non-compliance.

6.5 We may offer Service credits from time to time, and any provision of such credits is governed by the disclosures, terms and policies concerning the credits. You acknowledge and agree that all credits, whether previously offered or otherwise, are revocable or subject to early expiration at any time and for any reason or no reason by us, including for abuse, misrepresentation of Account information, unauthorized transfer, or illegal conduct by you.

7. Third Party Services

The Websites and Services may include links to third party websites, services or other resources on the Internet, and third party websites, services or other resources may include links to our Websites and Services as well. When you access third party resources on the Internet, you do so at your own risk. These third party resources are not under our control, and, to the fullest extent permitted by law, we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such resources. The inclusion of any such link does not imply our endorsement or any association between us and any third party. To the fullest extent permitted by law, we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third party resource. . It is your responsibility to protect your system from risks such as viruses, worms, Trojan horses and other security risks that may be presented by the third party resources as described in this section.

8. Confidentiality & Beta Services

8.1 To the extent you receive or possess any nonpublic information from us that is designated confidential or, given the nature of the information or circumstances surrounding its disclosure, reasonably should be understood to be confidential, such information is our "Confidential Information" and must be handled according to this TOS. Confidential Information includes but is not limited to: (a) nonpublic information about our technology, customers, business plans, marketing and sales activities, finances, operations and other business information; and (b) the existence and content of our discussions or negotiations with you regarding your Account and/or use of the Services. Confidential Information does not include any information that: (i) is or becomes publicly available without breach of this TOS; (ii) can be shown by documentation to have been known to you at the time of your receipt from us; (iii) is received from a third party who did not acquire or disclose the information by a wrongful or tortious act or by violating the rights of us or third parties; or (iv) can be shown by documentation to have been independently developed by you without reference to the Confidential Information.

8.2 You may not use Confidential Information except in connection with your use of the Service as permitted under this TOS or as separately authorized in a signed writing by us. You agree to not disclose Confidential Information during the term of this TOS, after you cease using the Services and after this TOS otherwise no longer applies. You will take all reasonable measures to avoid disclosure or unauthorized use of Confidential Information, including at least the measures you take to protect your own confidential information of a similar nature.


9. No Warranty

9.1 The Websites and Services, including without limitation any content delivered as a part thereof, are provided "as is" and on an "as available" basis. Loprice disclaims all warranties of any kind, whether express or implied, relating to the Websites and Services and all content delivered in connection thereto, including but not limited to: (a) any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; (b) any warranty arising out of course of dealing, usage, or trade; or © any warranty or guaranty relating to availability, accuracy, error rate, system integrity, or uninterrupted access. We do not warrant that: (i) the Websites or Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the Websites or Services is free of viruses or other harmful components; or (iv) the results of using the Websites or Services will meet your requirements. Your use of the Websites and Services is solely at your own risk.


9.2 Loprice is not responsible for the content that you access through your use of the Websites, Services, or content of other users of Loprice or other third parties. To the extent permitted by applicable law, you release us from all liability relating to such content. You acknowledge and agree that we make no representations concerning any content contained in or accessed through the App or content of other users of Loprice or other third parties, and that we are not responsible or liable for the accuracy, quality, legality, or other attributes of such content.

9.3 The limitations, exclusions, and disclaimers in this Section 9 apply to the fullest extent permitted by law. Loprice does not disclaim any warranty or other right that Loprice is prohibited from disclaiming under applicable law.

10. Limitation of Liability

10.1 To the fullest extent permitted by law, in no event will we be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the Websites and Services or any materials or content on the Websites and Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of damage. To the fullest extent permitted by law, you agree we will have no liability for any data that may be destroyed, lost or otherwise rendered inaccessible, whether because you failed to backup your data or for any other reason.


To the fullest extent permitted by law, you are responsible for your use of the Websites and Services, and you shall defend, indemnify, and hold harmless us and our employees, officers, directors, agents, contractors, and representatives from all liabilities, claims, and expenses, including reasonable attorneys’ fees and costs, that arise from or relate to your Services Content, User Content, your End Users, or your access to or use of the Websites and Services, including your breach of this TOS or applicable law, willful misconduct, negligence, illegal activity, breach of security or data, unauthorized access to or use of your Account, or infringement of a third party's right, including any intellectual property, confidentiality, property or privacy right. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, without limiting your indemnification obligations with respect to that matter, in which event you will make best efforts to assist and cooperate with us in defending the matter at your expense.

11. Termination

While we prefer to give advance notice of termination, we reserve the right, in our sole discretion, to terminate your access to all or any part of the Websites and/or Services at any time, with or without notice, effective immediately. Any such termination may result in the immediate forfeiture and destruction of data associated with your Account. Except as otherwise set forth herein or expressly agreed between the parties, any and all fees paid to us are non-refundable and any and all fees still owed to us at the time of such termination shall be immediately due and payable. Upon termination, any and all rights granted to you by this TOS will immediately be terminated, and you must also promptly discontinue all use of the Websites and/or Services. 

12. Dispute Resolution and Arbitration

12.1 In the interest of resolving disputes between you and Loprice in the most expedient and cost-effective manner, you and Loprice agree that every dispute arising in connection with this TOS will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of this TOS, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of this TOS, if applicable. You understand and agree that, by entering into this TOS, you and Loprice are each waiving the right to a trial by jury or to participate in a class action.


13. Miscellaneous Provisions

13.1 Updates and Modifications. Loprice reserves the right to update, change or otherwise modify this TOS on a going-forward basis at any time and in Loprice's sole discretion. If Loprice updates this TOS, Loprice may provide notice of such updates, such as by sending an email notification to the email address listed in your Account and/or updating the "Last Updated" date at the beginning of this TOS. Updates will be effective on the date specified in the notice. By continuing to access or use the Websites or Services after the date specified in the notice or updated TOS, you are agreeing to accept and be bound by the updated TOS and all of the terms incorporated therein. If you do not agree to the updated TOS, then you may not continue to use the Websites or Services and your sole and exclusive remedy is to deactivate your Account and otherwise discontinue use of the Websites and/or Services.

13.2 General. This TOS, including all documents expressly incorporated by reference herein, constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter. Use of section headers in this TOS is for convenience only and will not have any impact on the interpretation of any provision. Any use of the singular shall be reasonably construed as if it also includes the plural, and vice versa. If not already specified, any use of "including" or "such as" shall be construed to mean "including but not limited to.” If any part of this TOS is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect. The failure to require performance of any provision will not affect our right to require performance at any other time after that, nor will a waiver by us of any breach or default of this TOS, or any provision of this TOS, be a waiver of any subsequent breach or default or a waiver of the provision itself.

13.3 Assignment. You may not assign, transfer or delegate this TOS or any of your rights and obligations under the TOS, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign, transfer or delegate this TOS or our rights and obligations under this TOS without notice or consent. Subject to this section, this TOS will be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns, and any assignment or transfer in violation of this section will be void.

13.4 Governing Law. This TOS and any dispute related thereto (including under Section 13) is governed by the laws of the United Republic of Tanzania without regard to conflict of law principles. 

13.5 Relationship of the Parties. The parties are independent contractors. This TOS does not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between the parties. Neither party, nor any of their respective affiliates, is an agent of the other for any purpose or has the authority to bind the other.

13.6 Force Majeure. Loprice shall not be liable for nonperformance of the terms herein to the extent that Loprice is prevented from performing as a result of any act or event which occurs and is beyond Loprice's reasonable control, including, without limitation, acts of God, war, unrest or riot, strikes, any action of a governmental entity, weather, quarantine, fire, flood, earthquake, explosion, utility or telecommunications outages, Internet disturbance, epidemic, pandemic or any unforeseen change in circumstances, or any other causes beyond our reasonable control.

13.7 No Third-Party Beneficiaries. This TOS does not create any third party beneficiary rights in any individual or entity that is not a party to this TOS.

We respect your privacy. Since we started Loprice , we’ve aspired to build our App with a set of strong privacy principles in mind.
Loprice provides you the ability to explore and find rental property at your local area . We also explain the steps we took to protect your privacy when you use our service. In such case we may requre you to give us certain permissions in order to facilitate our service to you.

Information we collect

Your device information. We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information including phone number, and device identifiers.

All data entered through the app dialog box including password and other choice made from different menu. How ever these types of data are not retained in the application but are transferred and store securely into our servers.

Customer Support. You may provide us with information related to your use of our Services, including copies of your messages, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to our app performance or other issues.

Third-part. We work and use third part providers and services to help us operate, provide, improve, understand, customize, support and market our service. We use e-money from different carrier provider and other company to receive donation or payments from you. They may give us information of you direct or indirect. Be notified that during the payments their terms and priviacy will govern when you use their service.
We (Loprice ) are full comply with Money Loundery Laws of the United republic of Tanzania and International laws governing online e-money transaction.


How We Use Your Information

We use all the information we have from you to help us operate, provide, improve, understand, customize, support, and market our Services.

In providing, we provide you a customer support improving, fixing and customize our service to meet your need .

We try to understand you our customer and improve our service by using information you provide to us and respond to any queries when you contact us.

We verify accounts during installation and during the purchase of our product and or service by using information we correct from you and ensure the security of our service

Customer's service fees

Our platform or app is intended to provide services with as less cost as possible.
Thanks to the open source software of different licenses we were able to make this platform. The main goal of this platform is to bling down the cost for various service we provide mainly, the tenants, when seeking house or room to make a home, as well as other services we provide that solves other problems to our customers.
However for that purpose and for the platform to prosper we have decide to charge fee for certain services in our platform as follows:

1. Tanzanian shillings, 50,000/= as a one time membership subscription fee for basic services in our platform. This means you will use all our basic service forever without paying additional money. For non Tanzanian is $25 as a one time subscription

2. Tanzanian shillings, between 0 and 3000/= in time when you need a live call visit to the site by the property manager. This fee is negotiatable and the purpose is to contribute for live video call site visit when someone needed to do so. In most case its enough to see house by photos and videos which wiil help you to know the where about of the site and enter the deal without this fee. For non Tanzanian is $0 to $3 per session fee.

3. Tanzanian shillings, 0/=  for video and voice call to Property manager when you found your rental house or room in the app and want to talk for more information or to finalize the deal (Carrier charge may apply from your Telephone provider or Internet Service Provider). For non Tanzanian is $0 

4. Tanzanian shillings, 0/= to meet with property manager for the purpose of contract preparation and to go to the site to see the environments for the confirmation before contract signing with the home owner. For non Tanzanian is $0

5. Tanzanian shillings, 0/= service fee to property manager in the time of deal signing. In our platform you wont need to pay extra money for service fee everytime you migrate to a new home.

6. For all other products and services which we offer to our platform, if we may decide to charge for them, their cost or price will be on the respective products or service descriptions.

7. We use third part Payment Processors to receive payments. For that, any transaction done within our platform, these Payment Processors adds additional transaction fee on top of the total cost. These transaction fee will be shown before you make any payments. You agree with our terms also by making payments using Payment Processors.

8. DISCLAIMERS: We do not guarantee that by paying some of these fees; You will get service instantly as some of our products and services especially residentials can be available as we obtained them from home owners. Availability will depend on the speed we obtained them and or when our prior tenants released them on the market! By that be informed that for an "On payment" residential will be reserved for you for six (6) minutes before someone else is allowed to make payment for the same residential and you will not be able to pay for it until someone claims it and release it.

Piga picha (screenshot) hii ofa au chukua video yako ukisema "Tafuta nyumba tunakulipia pesa ya dalali" na uposti katika mitandao yako ya kijamii kuonesha watu wengine nao wanufaike na ofa wakati unafanya manunuzi ya akaunti yako ya ofa (Zingatia. Usiweke kwenye picha au video taarifa muhimu kama password na taarifa nyinginezo ambazo ni za muhimu na binafsi. Zingatia

6. Ofa hii ina muda maalum na itakuwa ikitolewa tangazo maalum na la wazi katika tovuti zetu (payments.loprice.co.tz au company.loprice.co.tz) muda wa kuanza na muda wa mwisho. Badala yake LOPRICE LIMITED itamchukulia kama mteja wetu wa kawaida ambaye anapata manufaa na huduma nyingine katika kampuni yetu pamoja na mifumo yake yote.

8. Hakutakuwa na malipo ya pesa ya dalali kwa mtu yeyote ambaye anafanya udanganyifu kwa lengo la kujipatia pesa ya ziada kwa namna yoyote ile. LOPRICE LIMITED inayo haki ya kujiridhisha kwanza uhalali wa malipo kwa mteja ambaye amevutiwa na ofa zetu kwa kutupa ushirikiano katika kufanikisha jambo hili la uhakiki.

9. LOPRICE LIMITED ni msimamizi wa makazi na pia ni mpangaji katika makazi kwa niaba ya wateja wetu.

1. Awe mteja wetu mwenye akaunti tayari na ambaye akaunti yake ni ya zaidi ya mwezi mmoja tangu kufunguliwa. Kwa mteja ambaye akaunti yake bado haijafikisha mwezi mmoja, mteja atawasilisha ombi maalumu na kusubiri kama litakubaliwa ama kukataliwa

2. Kodi anayotaka kulipa kwa ajili ya kukodisha chumba chake iwe ni kuanzia shilingi 1 hadi shillingi 300000/=

3. Mahali popote ndani ya Tanzania

4. Mkataba wa pango LAZIMA uwe ni kati yetu sisi (LOPRICE LIMITED) na mwenye nyumba wako. Ni JUKUMU LAKO kumfahamisha mwenye nyumba wako kwamba.
  a. Unapangisha nyumba yake na LOPRICE LIMITED
  b. LOPRICE LIMITED tutalipa pesa ya dalali wake kama yupo, na kama dalali huyo anahitaji kupokea malipo hayo.
  c. Wewe mteja wetu unakuwa mkazi wa LOPRICE LIMITED na unakuwa chini ya mashart ya mpangaji na mkazi ya LOPRICE LIMITED
  d. Muda wa mkataba wa LOPRICE LIMITED kama mpangaji wa nyumba katika nyumba yake (Mwenye nyumba) ni kuanzia miaka 5 na kuendelea
  e. LOPRICE itafanya malipo ya pango ya mkupuo kuanzia miezi 2 na si zaidi ya miezi 6 na kuendelea kulipa mwezi mmoja mmoja bila kukosa baada ya malipo ya mkupuo kuisha muda wake katika kipindi chote cha mkataba.
  f. Malipo yote ya pango yatalipwa na LOPRICE LIMITED kama mpangaji kwa mwenye nyumba kwa utaratibu utakaokubalika.
  g. Malipo yote ya huduma nyinginezo yatalipwa na LOPRICE LIMITED kwa maongezi na makubaliano na mwenye nyumba
  h. Ikiwa mwenye nyumba hakuhitaji (Wewe mteja wetu utakayekaa au unayekaa) kwenye nyumba yake (yaani mwenye nyumba) atatufahamisha sisi LOPRICE LIMITED na tutafanya mchakato wa kukutoa katika makazi kwa kufuata utaratibu wa maelewano kwa pande zote husika.
  i. Na ikiwa mwenye nyumba haitaji tena LOPRICE LIMITED kuwa mpangaji wake baada ya mkataba kuisha kampuni itaondoka bila mashart yoyote.
  j. Kuvunja mkataba wa upangaji (Yaani mwenye nyumba atapohitaji kuvunja mkataba na kampuni) masharti ni kwamba kampuni itahitaji kurudishiwa gharama (zitakazoainishwa) zilizoingiwa katika kipindi hicho kutoka kwa mwenye nyumba na kampuni itaondoka katika nyumba yake.
  k. Masharti yake yote ya kuishi kwenye nyumba yake hakikisha wewe mteja wetu umekubaliana nayo na yatakuwa sehemu ya masharti ya makazi ya LOPRICE LIMITED kwako wewe kama mkazi.

5. Ofa hii inazingatia wa kwanza kutangulia kutoa ombi ndio wa kwanza kuhudumiwa. Na watu wote watahudumiwa kwa usawa kwa kuzingatia uwezo wa kampuni kifedha.

6. Mteja wetu ambaye ana akaunti tayari ana haki ya kupata huduma hii MUDA WOTE na WAKATI WOTE na ukomo wake au kikwazo ni pale kampuni itakapoishiwa na fedha zilizotengwa kwenye ofa hii.

7. Malipo yote ya ofa hii yatahakikiwa na LOPRICE LIMITED ili yaendane na sheria zote za nchi.

8. LOPRICE LIMITED ni msimamizi wa makazi na pia ni mpangaji katika makazi kwa niaba ya wateja wetu.



NYUMBA YENYE MALIPO YA MKUPUO

Vigezo na masharti

1. Nyumba yenye ofa ya malipo ya mkupuo ya awali ukiipata utaendelea na malipo ya mwezi kama kawaida baada ya muda wa malipo ya mkupuo kuisha

2. Nyumba yenye ofa ya mkupuo itakuwa na malipo kidogo ya kimfumo.

3. Nyumba yenye ofa itakuwa tayari kufanyiwa malipo ya kimfumo baada ya muda wa kusubiria uliowekwa kuisha na atakayeweza kulipia wa kwanza ndio atakayeweza kuipata nyumba hiyo.

4. LOPRICE LIMITED inayo haki ya kuamua ni muda gani wa kusubiria uwekwe katika ofa ya nyumba husika bila kuingiliwa katika maamuzi yake.

5. Kwa kuwa ofa hii inasimamiwa na mfumo ikiwa kutatokea makosa ya kiufundi katika ofa nyumba husika itachukuliwa kama nyumba ya makazi ya kawaida ambayo inatolewa na LOPRICE LIMITED na malipo ya kimfumo yaliyofanyika kama yalifanikiwa ndio yatakuwa kama malipo ya awali ya mwezi huo kama hayajazidi gharama za kodi ya pango la mwezi la nyumba husika. Ikiwa ni vinginevyo muhusika atawasilisha swala lake katika kampuni kwa utatuzi zaidi.



PUNGUZO LA BEI YA MANUNUZI YA AKAUNTI

Vigezo na masharti

1. Bei ya punguzo ni bei yoyote mteja atakayoikuta wakati wowote ambayo ni pungufu ya bei ya kawaida ya akaunti ambayo ni shiligi 50,000/= za Kitanzania.

2. Bei ya punguzo utaikuta katika tovuti ya manunuzi wakati wa kulipia malipo ya akaunti

3. Kwa mteja anayesubiri bei ya punguzo kwenye akaunti, awe na kawaida ya kuangalia mara kwa mara kwa kuwa inaweza kuwekwa bila ya kutoa tangazo au taarifa yoyote.

MASHARTI YA JUMLA YA MPANGAJI NA MKAZI WA MAKAZI YANAYOSIMAMIWA NA LOPRICE LIMITED

Utangulizi

Dhana ya masharti ya mpangaji kwa mila na desturi zetu za kitanzania na baadhi ya jamii nyingi za kiafrika zimejikita sana katika kutengeneza mahusiano mazuri miongoni mwa jamii yote ya watu waishio katika nyumba moja ili kuleta ustawi katika maisha na kupunguza migogoro ambayo inaweza kuondoa maelewano, ushirikiano, utulivu na amani ya maisha katika nyumba au jamii hiyo. Katika jamii nyingi za kitanzania hili swala ni la kawaida na linafahamika na sisi kama kampuni tunategemea kwamba litakuwa sio tatizo miongoni mwa wateja wetu wote.

Pia kampuni inatoa tafsiri ya "Mkazi" kuwa ni mtu ambaye anaishi katika nyumba ambayo inamilikiwa na mwenye nyumba lakini mpangaji ni LOPRICE LIMITED ambaye amepanga kwa niaba ya mteja au wateja.
"Mteja" ni mtu yeyote mwenye akaunti moja au zaidi na kampuni yetu ya LOPRICE LIMITED
"Mwenye nyumba" ni mtu ambaye anamiliki nyumba ya makazi au mwenye mamlaka kamili juu ya milki ya nyumba husika kwa niaba ya mmiliki.
"Msimamizi wa nyumba" ni LOPRICE LIMITED au mtu yeyote ambaye amethibitishwa na kupewa wajibu wa kusimamia nyumba za wenye nyumba kwa niaba ya kampuni ya LOPRICE LIMITED

Tafsiri hizi hazina lengo la kubadili maana halisi ya tafsiri ya maneno haya katika matumizi ya istilahi na kamusi, bali lengo lake ni kuleta uelewa kwa wateja wetu ili kufahamu haki na wajibu wao wanapotumia huduma zetu katika kampuni kila linapotumika neno hilo.

Masharti ya Upangaji na Ukazi

1. Kabla ya kuingia katika mkataba
1.1. Kabla ya kuingia mkataba wa upangaji au ukazi mteja wetu mwenye akaunti atahakikisha amesoma masharti na vigezo vya huduma hiyo na kuelewa, pamoja na kufanya maamuzi ya kukubali au kukataa vigezo na masharti hayo.
1.2. Masharti haya ya upangaji na ukazi yatamuhusu mteja ambaye amekuwa mpangaji au mkazi
1.3. Kwa mpangaji ambaye atahitaji mkataba wa ziada au pale ambapo mwenye nyumba ameamua kutoa mkataba binafsi, masharti ambayo yamo kwenye mkataba huo vifungu vyake vyote na tafsiri zake zote zinaingia katika kifungu hiki na kuwa sehemu ya masharti haya ikiwa tuu havikinzani na masharti haya pamoja na sheria za Jamuhuri ya Muungano wa Tanzania.
1.4. Kwa kufanya malipo ya awali ya upangaji au ukazi wa nyumba ambayo mteja ameichagua kuishi ndio kiashiria kwamba mteja amekubaliana na vigezo na masharti haya na kwamba kuanzia muda huo malipo yaliyopitishwa, mteja husika ndio mpangaji au mkazi halali wa nyumba husika na anahusika na masharti na vigezo hivi.
1.5. Kwa nyumba ambazo hazijaorodheshwa kwenye mfumo, mteja akifanikiwa kufanya malipo na kutoa uthibitisho wake kwa msimamizi wa nyumba na kukubalika anakuwa mpangaji au mkazi halali wa nyumba aliyoichagua
1.6. Kila nyumba iliyoorodhesha katika mfumo ambayo haipo kwenye ofa ina takribani dakika sita (6) za zuio la malipo. Yaani kila mteja atakayewahi kuanzisha malipo katika mfumo kabla ya mwengine, mfumo utamlinda kwa kuweka zuio la muda wa dakika hizo ili aweze kufanya malipo. Dakika hizo zikiisha bila mafanikio, mfumo hautamruhusu kufanya malipo na badala yake nafasi atapata mteja anayefuata ambaye atawahi baada ya muda wa mteja wa awali kuisha. Ikitokea kuna tatizo la kiufundi katika mfumo una uwezo wa kuwasiliana na msimamizi wa nyumba husika kwa ajili ya kukulindia uwezo wa kufanya malipo katika nyumba hiyo. Mteja akifanikiwa anakuwa mpangaji au mkazi halali muda huo huo

2. Kipindi cha mkataba na maisha katika nyumba
2.1. Katika kipindi cha mkataba mpangaji au mkazi anapaswa kuitunza na kuilinda nyumba au makazi aliyokabidhiwa kutokana na uharibifu wa makusudi au uzembe. Yeyote atakayefanya uhalibifu wa mali yoyote katika nyumba husika atalazimika kuingia gharama za matengenezo za mali au vitu husika isipokuwa tu pale sababu inapokuwa ni majanga ya asili ambavyo chanzo sio uzembe wa kibinadamu.
2.2. Mpangaji au mkazi anapaswa kuwa na utu na ushirikiano ili kufanya maisha katika nyumba yaweze kuendelea kwa amani
2.3. Mpangaji au mkazi anapaswa kuwa na tabia njema kwa ujumla katika jamii inayomzunguka na kuwa balozi mkuu wa amani.
2.4. Mpangaji au mkazi anapaswa kuzingatia na kutunza vigezo vyote na masharti ya kuwa katika nyumba husika bila kuvivunja ili kuendelea kuwepo na kuishi katika nyumba hiyo kama ambavyo vimeainishwa katika mkataba wa makubaliano wa ziada au masharti haya ya jumla.
2.5. Mpangaji au mkazi anapaswa kulipa kodi ya pango na gharama nyinginezo anazostahili kulipa kwa wakati kila mwezi. Gharama hizi zote zinakuwa zimeainishwa na kukubalika katika makubaliano kabla ya kuingia katika nyumba hivyo ni jambo la busara kwa mpangaji na mkazi kufanya jambo hili kwa wakati. Endapo kuna changamoto za kipesa, toa taarifa mapema kwa msimamizi wako wa nyumba kwa utatuzi zaidi.

3. Ukomo wa mkataba, kuondoka katika nyumba
3.1. Mpangaji au mkazi anaweza kuondoka au kuhairisha mkata wakati wowote anapojisikia kufanya hivyo.
3.2. Mpangaji au mkazi anaweza kupeleka ombi la kubadili makazi kwa gharama za awali kwa mwenye nyumba yake ikiwa tuu ana historia nzuri ya malipo na tabia njema katika jamii husika kwa rekodi ya nyumba alizowahi kuishi kabla
3.3. Ikiwa mwenye nyumba hatahitaji mpangaji au mkazi kuendelea kuishi kwenye nyumba yake. Mpangaji au mkazi huyo atalazimika kuondoka katika nyumba hiyo kwa kufuata utaratibu wa maelewano na wa kisheria kwa pande zote hadi mwisho swala hilo litakaposhughulikiwa
3.4. Hakuna mpangaji wala mkazi atakayeondoshwa kwa kufukuzwa bila kufuata utaratibu na maelewano.

4. Malipo mbalimbali
4.1. Mpangaji au mkazi anapaswa kulipia pesa ya pango kwa mwenye nyumba au LOPRICE LIMITED kwa utaratibu uliowekwa wa kutumia "PAYMENTS PROCESSOR" kama njia ya malipo yote katika mfumo. Na ikiwa njia ya mfumo kuna changamoto basi malipo hayo yatalipwa benki moja kwa moja kwa utaratibu atakaoelezwa na watu wa malipo wa kampuni waliodhibitishwa.
4.2. Malipo ya huduma kama umeme, maji na taka ambazo hazijajumuishwa kwenye pesa ya pango zitalipwa kwa utaratibu watakaojiwekea wapangaji au wakazi au kwa kuzingatia masharti ya mwenye nyumba kama yatakuwepo kupitia kwa msimamizi wa nyumba wa LOPRICE LIMITED
4.3. Hakuna malipo yatakayofanyika nje ya utaratibu huu na ikitokea mteja amekiuka huu utaratibu na amefanya malipo ambayo hayajafika katika kumbukumbu za kampuni , malipo hayo yatakuwa ni batili na mteja hataruhusiwa kuendelea kupata huduma yoyote kutoka katika kampuni mpaka atakapofanya malipo yake kwa kufuata utaratibu.
